Terms of Service

1. Subject of the agreement and definitions

1.1. Subject: LifeUp ("Company") provides the User ("User") with access to the ZazaZu web service ("Service") for AI/algorithmic content generation, as well as access to advanced (custom) functionality under the terms of this Offer.

1.2. Digital credits ("Credits"): An internal unit of accounting for the volume of content generation operations available to the User on the Service. Credits do not constitute money, electronic currency, or securities; they are non-exchangeable for cash and non-refundable once used.

1.3. Custom features: Specialized functional capabilities of the Service (e.g., custom prompts/models, personalized settings), access to which is activated upon purchasing the corresponding Plan.

2. Purchase and consumption of credits

2.1. Fulfillment of obligations: The Company's obligation to sell a Plan/Credits is deemed fully and duly fulfilled at the moment the purchased package of Credits is credited and/or access to Custom Features is activated in the User's Personal Account.

2.2. Deduction logic: Credits are deducted from the User's balance at the moment a content generation request is sent. The number of Credits deducted per operation depends on the selected generation type and is displayed in the Service interface.

2.3. Validity period of credits: Purchased Credits are valid indefinitely from the moment they are credited to the balance.

2.4. AI Result disclaimer: The Service provides content generation tools on an "As Is" basis. The Company does not guarantee absolute accuracy, uniqueness, or compliance of the generated content with the User's subjective expectations. The deduction of Credits occurs for the fact of executing a computational operation by the algorithm, regardless of the User's evaluation of the obtained result.

3. Pricing, taxes, and payment terms

3.1. The cost of Plans is displayed on the website in the user's local currency depending on their country.

3.2. Prices exclude applicable sales taxes (GST/HST/PST in Canada). The total amount, including taxes, is calculated at checkout.

3.3. Payment is executed as a one-time charge in full via secure payment gateways.

4. Refund policy

4.1. Cancellation prior to credit usage: The User has the right to request a full refund within 14 calendar days from the moment of purchasing a Plan, ONLY if no Credits have been deducted from the account balance and the User has not utilized Custom Features.

4.2. Non-refundability upon partial/full usage: If the User executes at least one content generation operation (expending 1 or more Credits) or utilizes a Custom Feature, the service is deemed accepted and rendered in full. No refunds shall be issued for the given Plan/package (in accordance with digital content supply rules under PIPEDA / DPDP Act standards).

4.3. Technical malfunctions: In the event of a technical failure on the Service side resulting in Credits being deducted without outputting a generation result due to a server error, the Company shall compensate the User for the deducted Credits by re-crediting them to the balance in the Personal Account upon request sent to support@zazazuai.com.

5. Intellectual property and content rights

5.1. Rights to generated content: The User obtains the rights to use, publish, and commercially exploit content generated using their purchased Credits, subject to compliance with the Service's Terms of Use.

5.2. Acceptable use policy (fair use): It is strictly prohibited to use Custom Features and Credits to generate illegal, harmful, offensive content, or spam. In the event of a violation, the Company reserves the right to suspend or terminate the account without a refund.
